NHTSA's proposed amendment to Federal Motor Vehicle Safety Standard No. 135 (docket NHTSA-2026-0728) would remove the three-decade-old requirement that light vehicles have a foot-operated brake pedal, with the public comment period closing tomorrow, July 27, 2026.
If finalized, the rule would create the first permanent federal certification pathway for purpose-built driverless vehicles, replacing the current exemption-based system that has capped production.
The rule's outcome will determine whether Tesla's Cybercab and Amazon's Zoox can scale to mass production without hitting a regulatory production ceiling.
